Domain Name Disputes
Domain name disputes often arise if one party considers that their rights have been violated when another party has rights to a domain name.
These disputes can arise when one party is using a domain name in a manner which infringes another party's trademark rights. For example, if you have a domain name that contains a third party registered trademark and you are selling goods or services that are similar to the third party's good and services then this may give rise to trademark infringment.

As well, disputes can arise when one party wants a domain name that is owned by another party, whether or not the domain name is being used and whether or not the use of the domain name infringes any trademark rights. For example, you may not be using a domain name but the domain name contains a third party registered trademark. That third party may object to your ownership of the domain name because they wish to use the domain name.

Internet law is a branch of law that encompasses a number of different areas of law as they related to activity occuring over the Internet. Those areas of law include general commercial law, privacy law, copyright law, trademark law, domain name law, defamation and tax. What is interesting about the Internet is that its development permits many different ways for individuals and organizations to interact with one another. For example, the Internet permits individuals to easily reach any number of other indiviuals around the World.

On the other hand, much of the law relating to the Internet was developed before the Internet existed. This can create difficulties when activities on the Internet are shoe-horned into laws that were developed without the Internet in mind.
